2.DEFINITIONS
In this Agreement; SITE: The website and Trend Seyahat Mobile Application that can be accessed on-line, where various services and contents are offered within the framework determined by Trend Seyahat, and the SELLER: [MARMARA TREND TRAVEL ANONIM ŞİRKETİ: Natural or legal person who purchases the product / service offered through the website or application PRODUCT / SERVICE: Refers to the products and services offered by the Seller to the Buyer and which can be purchased. refers to.
3. SUBJECT MATTER OF THE CONTRACT
The subject of the product or service subject to this Distance Sales Contract is the determination of the mutual rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation in relation to the sale of flight tickets, flight ticket reservation services, cancellation, return and change services purchased by the Buyer and supplied by the Seller. The Buyer has the opportunity to be sufficiently informed about the basic qualities of the product or service through the Seller's website www.trendseyahat.com, mobile application and other information channels of Trend Seyahat, and accepts and undertakes that it has obtained sufficient information through these means. The Buyer accepts and undertakes that the goods or services in question are among the “Services performed instantly in electronic media or intangible goods delivered instantly to the consumer” specified in paragraph (ğ) of Article 15 of the Distance Contracts Regulation.
4. SERVICES AND PAYMENT INFORMATION
Flight Ticket:
The total price of the flight ticket to be purchased or reserved, including taxes, will be provided before the completion of the ticket purchase and/or reservation process. On the Trend Seyahat website, flight ticket purchases and reservations can be made for up to 7 passengers at a time. It is not possible to reserve a flight ticket solely for a child on the Trend Seyahat website; a child ticket must be reserved together with at least one adult. Infant passengers (0–2 years old) travel on an adult's lap and are not assigned a separate seat by the airlines.
Additionally, Trend Seyahat shall not be held responsible for any extra costs, fees, commissions, or any charges under any name that may be requested from the Buyer by intermediary institutions, such as banks, particularly in transactions made with credit cards.
When you confirm the ticket purchase, the amount of the flight ticket (including taxes and other fees) will be charged to the credit card used for payment. It is not mandatory for the credit card holder to be one of the traveling passengers. However, some airlines may require the credit card used for payment to be presented at check-in. In such cases, if the credit card cannot be presented, Trend Seyahat shall not be held responsible for the passenger's inability to board or for any related refund issues.
Some products or services offered by Trend Seyahat may now or in the future be subject to separate charges and may be excluded from the product or service purchased by the Buyer.

5. GENERAL PROVISIONS
5.1. The Buyer accepts and declares that he/she has read the basic qualities of the Products and Services subject to the Contract, the sales price including all taxes and the payment method and the full title, address and contact information of the Seller, which are detailed in Article 4 of this Agreement, in the “Preliminary Information Form” before this Agreement is concluded and that he/she has given the necessary confirmation electronically.
5.2. In addition to the terms of this Agreement, the parties accept and declare that they accept the provisions of the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation and that they will act in accordance with these provisions.
5.3. The product or service subject to this Agreement is one of the “Services performed instantly in electronic media or non-material goods delivered instantly to the consumer” specified in paragraph (ğ) of Article 15 of the Distance Contracts Regulation, and the service or non-material goods in question will be delivered to the Buyer at the time the Buyer approves the Agreement.
5.4. For the delivery of the Product/Service subject to the Contract, the price of the Product/Service must be paid in the payment method preferred by the Buyer. If for any reason the price of the Product/Service is not paid or is canceled in the bank records, the Seller is deemed to be released from the obligation to deliver the Product/Service.
5.5. If the buyer wishes to make a cancellation / refund in airline ticket sales transactions, it will be subject to the rules of the airline company with which it has made a transaction.
6. RIGHT OF WITHDRAWAL
6.1. Article 9 of the Distance Contracts Regulation published in the Official Gazette dated November 27, 2014 and numbered 29188 regulates the Right of Withdrawal and Article 15 regulates the Exceptions to the Right of Withdrawal. Accordingly; The Buyer accepts, declares and undertakes that he / she knows that he / she cannot use the right of withdrawal in the cases specified in Article 15 of the Law No. 6502 on Consumer Protection and Distance Contracts Regulation. These cases are as follows:
a) Contracts for goods or services whose price changes depending on fluctuations in financial markets and which are not under the control of the seller or provider.
b) Contracts for goods prepared in line with the wishes or personal needs of the consumer.
c) Contracts for the delivery of perishable goods or goods that may expire.
d) Contracts for the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; contracts for the delivery of goods whose return is not suitable in terms of health and hygiene.
e) Contracts relating to goods that are mixed with other products after delivery and cannot be separated due to their nature.
f) Contracts for books, digital content and computer consumables provided in material media if the protective elements such as packaging, tape, seal, package are opened after the delivery of the goods.
g) Contracts for the delivery of periodicals such as newspapers and magazines, other than those provided under a subscription agreement.
h) Contracts for accommodation, transportation of goods, car rental, provision of food and beverages, and leisure time for entertainment or recreation, which must be concluded on a specific date or period.
i) Contracts for services performed instantly in electronic environment or contracts for intangible goods delivered instantly to the consumer.
j) Contracts for services whose performance is initiated with the consent of the consumer before the expiration of the right of withdrawal period
k) Other goods and services considered outside the scope of the right of withdrawal in accordance with the relevant legislation
6.2. Right to Cancel/Refund: For tickets purchased through Trend Seyahat, the cancellation, refund and change rules of the airline companies you have made a transaction with are valid. These rules may vary depending on the airline companies and class differences. You can get information about the cancellation / refund rules from the airline company. Under all circumstances, the ticketing service fee you have purchased is non-refundable. In addition, according to the rules of the airline, the ticket may be refunded with a penalty or not accepted. Tickets included in the promotional class (“Special Rate Ticket”) are generally not subject to any cancellation, refund or change. Cancellation, refund and change conditions for tickets in Economy, Business and other classes may vary according to the rules of the airline you have chosen.
6.3. The refund of the ticket that is refundable or decided to be refunded by the relevant airline is made in accordance with the payment method used when purchasing the ticket. The time for the refunds to be credited to the relevant debit or credit card or to the Buyer's account may vary according to banks and card programs.
6.4. In case of No-Show (Failure to Use the Flight Right / Failure to show up for the flight), airline companies may refund only the airport taxes collected to the Buyer personally or to Trend Seyahat on behalf of the Buyer in cancellation and refund transactions. Ticket fee, ticketing service fee and fuel fee are not refundable. Refund procedures, refund method and refund period may vary depending on airline companies.
7. AUTHORIZED COURT
In disputes arising from the application of this Agreement, the Consumer Problems Arbitration Committees in the place where the Buyer purchased the goods or where the Buyer's residence is located up to the value announced by the Ministry of Commerce; Consumer Courts in the place where the Buyer or the Seller resides are authorized for disputes exceeding the said value.
8. ENFORCEMENT
All articles of this Agreement have been read and accepted by the Buyer and the Seller and this Agreement has entered into force as of the date of electronic approval by the Buyer.
